Nothing prepares a family for a sudden, preventable loss. Whether it’s a fatal crash, a hospital error, a defective product, or a violent attack at an unsecured property, Suli Law Group helps Florida families pursue justice and full financial recovery under the Florida Wrongful Death Act. Speak with a Florida wrongful death lawyer at Suli Law Group for clear guidance on your options.
Under Fla. Stat. §§ 768.16–768.26, when a death is caused by another’s negligence or wrongful act, the personal representative of the decedent’s estate may bring a single action on behalf of the estate and all qualifying survivors. Multiple separate lawsuits are not permitted — every claim must be coordinated into a single case under the Florida Wrongful Death Act.
Eligible survivors include:
• The surviving spouse
• All children (with “minor children” defined as under 25 in this Act)
• Parents of the decedent
• Blood relatives or adoptive siblings partly or wholly dependent on the decedent for support
Each survivor has distinct rights to recover. The estate itself can also recover lost earnings and lost prospective net accumulations.
Suli Law will look to fight for you on the following:
• Lost financial support and services, past and future
• Loss of companionship, protection, instruction, and guidance
• Mental pain and suffering of the surviving spouse, parents, and minor children
• Medical and funeral expenses
• The estate’s lost earnings and net accumulations
• Punitive damages in egregious cases
Founding attorney Laura Sulisufay is a former insurance defense attorney. She built her career defending insurance companies. Now, she uses that insider knowledge against them. Our team knows exactly how adjusters value claims, where they cut corners, and what evidence forces a fair offer.
Only the personal representative of the deceased’s estate can file, and they bring a single action on behalf of the estate and all qualifying survivors.
Eligible survivors include the surviving spouse, all children (with “minor children” defined as under 25 under the Act), parents of the decedent, and blood or adoptive relatives who were partly or wholly dependent on the decedent.
Generally, two years from the date of death, though claims against government defendants require additional pre-suit notice, and there is no statute of limitations if the death resulted from murder or manslaughter.
Lost financial support and services, loss of companionship and guidance, mental pain and suffering, medical and funeral expenses, the estate’s lost earnings and net accumulations, and punitive damages in egregious cases. These are the wrongful death damages Florida law recognizes in many situations.
