Florida injury cases come down to four things. Someone owed you reasonable care. They didn’t give it. That failure caused your injury. And the injury cost you something real: medical bills, missed work, pain that changed how you live. If those four line up, you likely have a case. March 24, 2023 · HB 837
On March 24, 2023, Florida’s HB 837 became law and rewrote the rules for injury cases. Three changes matter most to you.
Less time to file. For most injuries after March 24, 2023, you have two years to file a lawsuit. It used to be four. Fla. Stat. § 95.11(5)(a).
More than half at fault, and you recover nothing. If you are found more than 50 percent at fault for your own injury, you recover nothing. At 50 percent or less, your award drops by your share. Fla. Stat. § 768.81. Medical negligence cases follow a different rule.
Your medical bills get a harder look. For bills already paid, a jury now hears only the amount actually paid. Fla. Stat. § 768.0427.
Each change rewards whoever moves first. Footage often gets recorded over within days. The fight over fault is won with proof gathered early. That’s why we start building your case the day you call.

It means you can’t recover anything if you are found more than 50 percent at fault for your own injury, Fla. Stat. § 768.81(6). At 50 percent or less, you can still recover, minus your share. That is exactly why insurers inflate your share of the blame, and why we answer it with evidence. The rule does not apply to medical negligence cases.
