No Attorney-Client Relationship Arises from Use of the Site

The law differs in every jurisdiction, and you should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fully informed of all the pertinent facts, who is licensed in the applicable state, and who is familiar with the applicable law. Internet subscribers, mobile application users, and online readers should seek professional counsel about their legal rights and remedies. You should not act or refrain from acting on the basis of any information found on the Site. Any actions or decisions about your legal rights should be based on the particular facts and circumstances of your situation, and on appropriate legal advice from an attorney retained directly by you. THE FIRM EXPRESSLY DISCLAIMS ALL LIABILITY WITH RESPECT TO ACTIONS TAKEN OR NOT TAKEN BASED UPON ANY INFORMATION OR OTHER CONTENTS OF THIS SITE.

The content and features on the Site do not create, and are not intended to create, an attorney-client relationship, and shall not be construed as legal advice. The content and features of the Site, including any means to submit a question or information, do not constitute an offer to represent you or otherwise give rise to an attorney-client relationship. An attorney-client relationship with the Firm is established only upon the execution of a written, mutually signed engagement or retainer agreement.

THE SITE IS PROVIDED “AS IS.” THE FIRM MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ONLINE SERVICES AND HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND OR NATURE, INCLUDING, WITHOUT LIMITATION,

THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. In connection therewith, you agree to provide and maintain true, accurate, current, and complete information about yourself. Confidentiality and Prospective Clients

Information sent to Suli Law, PLLC via internet, email, text, or through the Site is not transmitted through a secure channel. Submitting information through the Site does not create an attorney-client relationship.

If you are inquiring about possible representation, please be aware that the Florida Rules of Professional Conduct provide certain limited protections for information shared by prospective clients. However, to ensure full confidentiality of sensitive case information, please do not send detailed case facts, documents, or confidential information through the Site or by email until an attorney-client relationship has been established through a signed retainer agreement.

The Firm takes commercially reasonable measures to secure and protect the information that we collect, but because of the nature of internet communications, we cannot promise or guarantee that information transmitted through the Site is secure.

Indemnification

To the fullest extent permitted by applicable law, you will defend, indemnify, and hold harmless Suli Law, PLLC, its officers, directors, agents, partners, employees, members, managers, shareholders, independent contractors, service providers, consultants, and their respective directors, employees, and agents (individually and collectively, the “Firm Parties”), from any and

all claims, losses, liabilities, damages, fees, expenses, and costs (including attorneys’ fees, court costs, damage awards, and settlement amounts) that result from any claim or allegation against any Firm Parties arising in any manner from: (1) your access to or use of the Site; (2) any Submissions you provide through the Site; and (3) your breach of these Terms of Use. The Firm will provide you with notice of any such claim or allegation, and the Firm will have the right to participate in the defense of any such claim at its expense.

The Firm Is Not Responsible for Content; Limitation on Liability

The Firm may periodically change, remove, or add the material on the Site without notice. This material may contain technical or typographical errors. THE FIRM DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR SUITABILITY OF ANY INFORMATION OR CONTENT ON THE SITE, AND YOU SHOULD NOT CONSTRUE THE FIRM’S PUBLICATION OF INFORMATION OR CONTENT ON THE SITE AS A WARRANTY OR GUARANTEE OF ANY KIND. The Firm assumes no liability or responsibility for any errors or omissions in the contents of the Site. Your use of the Site is at your own risk. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL ANY FIRM PARTIES BE LIABLE TO YOU OR ANY OTHER PERSON UNDER ANY THEORY OF LIABILITY (WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, WARRANTY, STRICT LIABILITY, OR OTHERWISE) FOR ANY LOST PROFITS, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS OF USE OR YOUR ACCESS TO, OR USE OF, THE SITE, ANY FIRM TECHNOLOGY, OR ANY LINKED WEBSITE, EVEN IF THE FIRM OR ANY FIRM PARTIES WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING LOSS OF PROFIT, REVENUE, BUSINESS INTERRUPTION, TIME, OPPORTUNITY, COST TO PROCURE SUBSTITUTE SERVICES, OR GOODWILL.

THE FIRM’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS OF USE AND THE FIRM’S PROVISION OF THE SITE AND ANY OTHER FIRM TECHNOLOGY, WHETHER IN CONTRACT OR TORT OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (1) THE TOTAL AMOUNT YOU ACTUALLY PAID TO THE FIRM FOR USE OF OR ACCESS TO THE SITE IN THE PRECEDING THREE (3) MONTHS, OR (2) FIVE HUNDRED DOLLARS ($500).

Any cause of action or claim you may have with respect to these Terms of Use, the Site, or any Firm Technology must be commenced within six (6) months after the claim or cause of action arises, or such claim or cause of action shall be barred.

YOU AGREE THAT THE FIRM WOULD NOT PROVIDE YOU ACCESS TO, OR USE OF, THE SITE OR ANY FIRM TECHNOLOGY WITHOUT THESE LIMITATIONS ON ITS LIABILITY. IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR

INCIDENTAL DAMAGES IS NOT PERMITTED, THE FIRM’S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. The limitations and exclusions set forth above will not limit or exclude liability for the Firm Parties for any matters in which liability cannot be excluded or limited under applicable law.

Third-Party Websites

The Site contains links to third-party websites for the convenience of our users. The Firm does not endorse any of these third-party sites and does not imply any association between the Firm and those sites. The Firm does not control these third-party websites and cannot represent that their policies and practices will be consistent with these Terms of Use. If you use links to access and use such websites, you do so at your own risk. The Firm is not responsible for the contents or availability of any linked sites. These links are provided only as a convenience to the recipient. These Terms only apply to the Site and do not apply to any linked sites. We encourage you to read and understand the terms of use of any linked sites that you visit. Links do not imply that we sponsor, endorse, are affiliated with or associated with, or are legally authorized to use any trademark, trade name, service mark, design, logo, symbol, or other copyrighted materials displayed on or accessible through any linked site.

State Laws Vary

The Firm has lawyers who are licensed to practice law in Florida. The Firm may refer prospective clients to other law firms located throughout the country who form relationships with the Firm and are experienced in handling such cases. The Firm may also undertake legal representation in certain cases and will affiliate with other legal counsel located throughout the country to provide legal representation.

The laws of each state are different. The Site contains information about general or common rules that apply in some states. The Site also contains information about verdicts or settlements in past cases. You cannot assume that the same rules apply, or that the same result would occur, in your state or any particular state.

The statute of limitations is especially important. Every state has laws called the “statute of limitations” which set a deadline to file a lawsuit. A lawsuit filed too late may be thrown out, regardless of the defendant’s fault or the severity of the injuries. Some states have a two-year period for negligence injury claims; the time period in other states may be longer or shorter. Insurance policies, particularly homeowners insurance, may require that suit be filed within a specific period after a loss. Some states allow claims against government agencies, but require a written notice very soon after the accident. Because investigation and research are needed to

identify all possible defendants and theories of recovery, if you have an accident or injury, you should consult a lawyer as soon as possible.

Suli Law Clients

Only individuals who have entered into a mutually signed retainer agreement with the Firm are Suli Law clients (“Firm Clients”). When Firm Clients use such portions of the Site designated by the Firm to communicate with us pursuant to our representation of a Firm Client, we will ensure that any information provided pursuant to such attorney-client relationship is not shared with third parties except with such precautions as are reasonably designed to preserve the confidentiality of the relevant information and any attorney-client privilege as may attach to such information.

The Firm takes commercially reasonable measures to secure and protect the information that we collect.

Legal and Ethical Requirements

The Firm has tried to comply with all legal and ethical requirements in compiling the Site. We welcome comments about our compliance with the applicable rules and will update the Site as warranted, upon learning of any new or different requirements. To the extent that the professional responsibility rules of any jurisdiction require us to designate a principal office or an attorney responsible for the Site, Suli Law, PLLC designates its office at 3411 W. Fletcher Avenue, Suite B, Tampa, Florida 33618, USA, and attorney Laura Sulisufay as the attorney responsible for the content of the Site.

Those experiences are personal to those clients and are not necessarily representative of all clients of the Firm. Your individual results will vary. Testimonials appear on the Site in the form provided by the client (text, audio, or video) and are reviewed by the Firm before posting. Testimonials may be edited only for grammar, typographical errors, or brevity where the full testimonial contains extraneous information not relevant to the general public. Clients are not compensated for providing testimonials. The views and opinions expressed in testimonials belong solely to the individual client and do not reflect the views or opinions of the Firm.

  3. A statement that you have a good-faith belief that the use of the copyrighted work is not authorized by the owner, the owner’s agent, or the law;
  4. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed; and
  5. Your electronic or physical signature.

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to any choice of law principles. Any and all disputes arising hereunder shall be governed as set forth in the Arbitration section below.

Arbitration

Any and all claims by you arising out of or related to the Site or your use thereof — but excluding (a) claims that may be brought in small claims court, (b) claims arising from an attorney-client relationship between you and the Firm, which shall be governed by the terms of your retainer agreement, and (c) claims for injunctive relief related to intellectual property — may be resolved only through a binding arbitration proceeding to be conducted under the auspices of the Consumer Arbitration Rules of the American Arbitration Association in Hillsborough County, Florida.

Both your agreement to arbitrate all controversies, disputes, and claims, and the results and awards rendered through the arbitration, will be final and binding on you and may be specifically enforced by legal proceedings. Arbitration will be the sole means of resolving such controversies, disputes, and claims, and you waive your rights to resolve such controversies, disputes, and claims by court proceedings or any other means. You agree that judgment may be entered on the award in any court of competent jurisdiction.

CLASS ACTION WAIVER. The arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding. YOU AND THE FIRM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Confidentiality of Arbitration. The details, existence, and outcome of any arbitration, and any information obtained in connection with any arbitration (including any discovery taken in connection with any arbitration), shall be kept strictly confidential and shall not be disclosed or discussed with any person who is not a party to, or a witness in, the arbitration; provided that a party may make such disclosures as are required by applicable law or legal process; provided further that a party may make such disclosures to its attorneys, accountants, or other advisors who reasonably need to know the disclosed information in connection with the arbitration and who are obligated to keep such information confidential to the same extent as such party; and provided further that a party may make such disclosures to the extent necessary to enforce any arbitration award.

You understand that by agreeing to arbitration as a mechanism to resolve all controversies, disputes, and claims between us, you are waiving certain rights, including the right to bring an action in court, the right to a jury trial, the right to broad discovery, and the right to an appeal. You understand that in the context of arbitration, a case is decided by an arbitrator (one or more), not by a judge or a jury.

International Use

The Site is controlled, operated, and administered by the Firm from offices within the United States of America and is intended for use within the United States. We make no representation regarding the use of the Site outside of the United States.

Other Terms

If, for any reason, any provision of these Terms of Use or our Privacy Policy is found to be invalid, void, or unenforceable, such provision shall be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms of Use and the Privacy Policy shall continue in full force and effect.

The Firm’s failure to act with respect to a breach by you or others does not waive our right to act with respect to that breach or subsequent or similar breaches. No consent or waiver by the Firm hereof will be deemed effective unless in writing.

These Terms of Use, together with our Privacy Policy, as each is currently posted, constitute the entire agreement between the Firm and you with respect to your use of the Site and supersede all previous written or oral agreements relating to the subject matter hereof, except that this agreement shall not supersede, restrict, or replace any agreements governing the attorney-client relationship between the Firm and Firm Clients.

The Firm may, in its sole discretion and without prior notice, block and/or terminate your access to the Site if we determine that you have violated these Terms of Use or other terms or agreements that may be associated therewith, or if you use the Site in a way that we deem, in our sole discretion, to be unacceptable.
